TERMS AND CONDITIONS

The purpose of these Terms and Conditions is to regulate the commercial relationship between ROOM00 HOSTELS & HOTELS S.L.U., depending on the hotel where the reservation is made (hereinafter “Room00 Group”), and its clients (hereinafter the “Client”). Room00 Group owns, operates, and manages a number of properties under its Letoh, Select, TOC, and Room00 brands, as well as a number of websites and applications for receiving, managing, and accepting hotel reservations (its “Websites”), including through the websites of Room00 Group’s reservation service providers (hereinafter the “Provider Website”). These Terms and Conditions, along with all legal texts such as the Privacy Policy, Legal Notice, and Cookie Policy, constitute the contract between the Parties (collectively, the “Conditions”).

• SERVICE CHARACTERISTICS
  
  

Room00 Group, through its Websites, as well as through third-party booking service providers, provides accommodation booking services (hereinafter, the “Accommodation/s”) from which the Client can book rooms in hotels or other types of accommodation managed by Room00 Group (hereinafter, the “Services”).

• BOOKING CONDITIONS
  
  

To book accommodation with Room00 Group, the customer must be of legal age.
When booking accommodation with Room00 Group, the customer must follow these steps:

• Enter search criteria: The Client must provide Room00 Group or the booking service providers with the booking details to determine accommodation availability. These details include the dates and the number of people who wish to book the Room00 Group accommodation. If there is no availability according to the requested conditions, the Client must re-enter the search criteria according to their preferences to book an available accommodation.
· Select the room type: If accommodations are available, the Client must indicate the type of accommodation they prefer in order to make the reservation.
• Additional services: Along with the Accommodation booking, the Client must indicate if they wish to book additional services such as breakfast service, cancellation service, Accommodation amenities, among others.
· Payment: Once the room and complementary services have been selected, the Client will proceed to pay for the Services.

Once payment for the Services has been made, the Client will receive an email confirming the booking of the Accommodation for the dates and according to the conditions indicated to Room00 Group.

• PAYMENT PROCEDURE
  
  

The Client may contract Room00 Group’s Services through the payment procedure provided on the Room00 Group Website or those of its booking service providers. Once this procedure is completed, the Client must accept these Terms and Conditions, which establish the general framework for the contractual relationship between the parties.
Upon acceptance of the Terms and Conditions, the Client will pay the price of the Services through the payment gateway contracted by Room00 Group.
Any contracted Service may be rejected or canceled by Room00 Group if there is a clear error in the price or if the information regarding the services, billing, and/or payment details is insufficient or inaccurate. Services may also be canceled if there are well-founded suspicions that they were carried out using stolen billing information, appear to be related to fraud, or are related to a previous payment dispute.

• PRICES
  
  

The prices for Room00 Group Services will be those defined at any given time on its Websites and/or those indicated on the websites of its hosting service providers, depending on the Website through which the Client contracts the Services.
The amounts paid by the Client for the contracting of the Services will not be refundable, unless the Client has expressly contracted the free cancellation option of the Services, which will be applicable according to the conditions established for each specific case.
Room00 Group reserves the right to modify the prices indicated on its Websites without these changes affecting Services already contracted or those being carried out at the time of the price change.
The price shown on the Room00 Group websites or their booking service providers does not include local overnight taxes, which, if applicable, must be paid at Room00 Group accommodations.

• RIGHT OF WITHDRAWAL (CANCELLATION POLICY)
  
  

The user acknowledges and accepts that, once the Services have been contracted, Room00 Group will not be obliged to offer a right of withdrawal, pursuant to the regulations applicable to the consumer since it applies the exception contemplated in article 103.L of the consolidated text of the General Law for the Defense of Consumers and Users (“TRLGDCU”).
Therefore, as a general rule, early cancellation of the Services will not entitle the Client to a refund from Room00 Group. Notwithstanding the foregoing, the Client may only cancel the Services early if they have contracted cancellation services, which will be applicable according to the terms and conditions agreed upon in each case.

• CUSTOMER OBLIGATIONS
  
  

When you contract Room00 Group Services:

a) The Client will provide Room00 Group with the necessary information for the provision of the Services. All information provided by the Client must be truthful, accurate, and legal. Room00 Group will not be liable if the Client provides incorrect or fraudulent information.
b) The Client will use the Services in accordance with applicable regulations and these Terms and Conditions, as well as in good faith and in compliance with public order regulations. If the Client breaches its obligations under these Terms and Conditions, it will be liable for any damages caused to Room00 or third parties.
c) The Client will pay the price of the contracted Services according to the conditions established in each case:
a. Any reservation or payment that is irregular, inoperative, incomplete, or fraudulent for any reason attributable to the Client will result in the cancellation of the Service reservation, without prejudice to any other actions that Room00 Group may take against it;
b. Room00 Group reserves the right to evict the Client from the Accommodation during the provision of Services and before their completion, without right to compensation or refund, when the Client’s behavior is contrary to good faith and public order within the Accommodation. If payment has not been made, the Client must pay the price of the Services before leaving the Accommodation.
d) The Client will at all times respect the rules of conduct of the Accommodation and must make proper use of its furnishings.

• VALIDITY
  
  

These Terms and Conditions will be in effect from the date of the contracting of the Services by the Client until their completion.

• RESPONSIBILITIES
  
  

Room00 Group has made every effort to ensure that the information on its websites is accurate and up-to-date. However, Room00 does not guarantee or assume responsibility for the accuracy and timeliness of the content on its websites. Room00 Group is not liable for any errors or omissions in the content of its websites or the Supplier Website and reserves the right to modify this content at any time.
Room00 Group is not responsible for errors or malfunctions in the operation of its websites, whether inherent or due to the characteristics and limitations of the internet or the Supplier Website. The Client assumes all risks arising from internet use, including the possible transmission of computer viruses. Room00 Group does not guarantee the uninterrupted operation of the services on its websites or the Supplier Website and will not be liable for any damages that may result from service interruptions. In particular, Room00 Group will not be liable in circumstances of force majeure such as fires, strikes, power outages, or any other unforeseeable or unavoidable events, nor for the Client’s improper use of its Websites in accordance with these Terms and Conditions.

In any event, Room00 Group will only be liable for damages that were foreseeable or could have been foreseen at the time of the Client’s use of its Websites and that are a direct and necessary consequence of the Client’s gross negligence in breaching substantial contractual obligations. The fact that its Websites and/or the Supplier Websites describe or present certain services does not imply a commitment by Room00 Group that those services will be available to the Client.
The exclusion of liability and warranties described in this section will apply to Room00 Group and its directors, officers, employees, and representatives.

• GUARANTEES
  
  

Room00 Group guarantees that the Services will substantially conform to the characteristics and description found in these Terms.
Room00 Group does not guarantee that the Services will be uninterrupted or error-free for a specific purpose; however, the Client has the right to expect that the services will be of satisfactory quality and conform to their description.
With the exception of the express warranties described in this section, and to the maximum extent permitted by applicable mandatory law, the Services and any technology or access to them provided by Room00 Group under these Terms are provided “as is” and Room00 Group makes no warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.
If the Client considers that the services received do not meet the minimum characteristics established in this document, they may notify Room00 of this circumstance through the means of communication provided in these Conditions.

• INTELLECTUAL PROPERTY RIGHTS
  
  

The Client expressly acknowledges that Room00 Group owns the industrial and intellectual property rights to its Websites, and therefore it is expressly understood that these Terms and Conditions do not grant the Client any intellectual property rights over them except those expressly recognized. The Client may not use the Websites for purposes other than those described in these Terms and Conditions.
Any use of the content for which Room00 Group has not given express authorization, whether direct or indirect, for profit or not, including downloading, storage, transmission, public disclosure, distribution, reproduction or transformation, reuse, or the use of scraping techniques, for private or commercial purposes, in whole or in part, is expressly prohibited. bchange may take all legal and extrajudicial actions it deems appropriate in the event of any infringement of its rights.

• PROTECTION OF PERSONAL DATA
  
  

All personal data provided to Room00 Group within the framework of the provision of the Services will be processed in accordance with the Room00 Group Privacy Policy.
In the event that, for the contracting of the Services, it is necessary for the Client to provide Room00 Group with personal data of interested third parties, the Client guarantees that it has legitimately obtained the consent (or any other applicable legal basis) of said interested parties for the processing of their personal data and to provide them to Room00 Group for the contracting and provision of the Services.
When the personal data of third parties are of minors under 14 years of age, the Client guarantees that he is the father, mother or legal guardian of the minor and that he therefore consents, or that, otherwise, he has the express consent of the father, mother or legal guardian of the minor to process his personal data and provide it to Room00 Group for the contracting and provision of the Services.

• LINKS TO THIRD PARTIES
  
  

The Websites may contain links to websites, applications, or similar content that are the responsibility of third parties. When the Customer clicks on such links and leaves the Websites, Room00 Group does not control and is not responsible for the third-party content accessed by the Customer. Room00 Group does not review, approve, or monitor such third-party content accessible through these links. The Customer’s use of all third-party links is at their own risk.

• COMMERCIAL COMMUNICATIONS
  
  

Unless the Client expressly withdraws their consent and during the validity of the Terms with the Client, Room00 Group will send commercial communications to keep the Client updated on all news, as well as any type of information from Room00 Group or the services it provides that may be of interest to them.

• CLAIMS
  
  

The User may submit a complaint by contacting Room00 Group via email at administracion@room00group.com or by any other means of contact enabled on the Platform.

• MODIFICATIONS
  
  

Room00 Group reserves the right to modify these Terms and Conditions at any time. Changes or updates to the Terms and Conditions, as well as the Privacy Policy, will be explicitly notified to the Customer through a notice on its Websites.

• COMPETENT JURISDICTION
  
  

Since Room00 Group is established in Spain, to the extent permitted by mandatory regulations, Spanish common law shall apply.
The competent courts shall be those of the city of Madrid. This is without prejudice to the jurisdiction established by mandatory regulations, to any out-of-court procedures to which the parties voluntarily submit, and to the provisions of the preceding section on Claims.
